NOTICE OF PUBLIC HEARING 

NOTICE IS HEREBY GIVEN that the Town Board of the Town of Roxbury, Delaware County, New York, will meet at the Town Hall, 56 Hillcrest Drive, in Roxbury, New York, on May 12, 2025, at 6:00 P.M., Eastern Time, for the purpose of conducting a public hearing in relation to the proposed increase and improvement of the facilities of the Town’s Denver Sewer District in the Town of Roxbury, Delaware County, New York (the “District”), consisting of improvements to the sewer collection system and the wastewater treatment plant, including incidental expenses in connection therewith and site improvements, as needed, all as more fully described in a Map, Plan and Report, dated April 11, 2025 and prepared by Lamont Engineers (the “Engineering Report”), at an estimated maximum cost of $4,730,000.  The proposed plan of financing such project includes: (i) the issuance of up to $500,000 of bonds of the Town, expected in the form of a low interest loan from New York State Environmental Facilities Corporation (“EFC”), and (ii) approximately $4,230,000 is expected to be funded with (a) funds of the District (i.e., the City of New York’s Regulatory Upgrade share), (b) a Water Infrastructure Improvement (WIIA) grant and/or a Bipartisan Infrastructure Law (BIL) grant from EFC.  The repayment of any bonds to be issued for said project shall be allocated and charged as the cost of capital improvements to the facilities of the District and shall be borne by the District.

The Engineering Report, including estimate of cost, relating to this project, is on file in the Office of the Town Clerk where it is available for public inspection during normal business hours. 

An environmental analysis has been prepared pursuant to the regulations of the New York State Department of Environmental Conservation promulgated pursuant to the State Environmental Quality Review Act in connection with such increase and improvement of the facilities of the District and it has been determined by the Town Board that such increase and improvement of the facilities of the District and the use thereof will not have a significant adverse environmental impact. 

At said public hearing said Town Board will hear all persons interested in the subject matter thereof.
