NOTICE IS HEREBY GIVEN that the Town Board of the Town of Roxbury, Delaware County, New York, will meet at the Roxbury Town Hall, in Roxbury, New York, in said Town, on January 3, 2017 at 7:15 o’clock P.M., Prevailing Time, for the purpose of conducting a public hearing in relation to the proposed increase and improvement of the facilities of the Town’s Denver Water District, consisting of various capital improvements to the facilities of the Denver Water District, including wellfield electrical improvements, pumping and treatment improvements, controls system improvements, pressure reducing valve vault replacement, water main and service replacements, hydrant and valve replacements, storage tank rehabilitation, emergency generators, and various building and site improvements, in the Town of Roxbury, Delaware County, New York, all as more fully described in the August 31, 2016 Preliminary Engineering Report of Lamont Engineers, Cobleskill, New York, and including incidental expenses in connection therewith, at an estimated maximum cost of $1,000,000.
The aforesaid project has been determined by the Town Board to be a “Type II” Action pursuant to the regulations of the New York State Department of Environmental Conservation promulgated pursuant to the State Environmental Quality Review Act, the implementation of which, as proposed, the Town Board has determined will not result in any significant environmental effects.
At said public hearing said Town Board will hear all persons interested in the subject matter thereof.

A Special Meeting of the Town Board was held November 21, 2016 at 7:00 pm at the Town Hall. Present were: Supervisor Thomas S. Hynes, Councilmen Gene Cronk, Edward Raeder, Allen Hinkley and Carol Murray and 1 resident.

A Special Meeting of the Town Board was held November 21, 2016 at 7:00 pm at the Town Hall. Present were: Supervisor Thomas S. Hynes, Councilmen Gene Cronk, Edward Raeder, Allen Hinkley and Carol Murray and 1 resident.
The meeting was called to discuss matters concerning Denver Water District and any other business that may come before the Town Board.
Sealed bids for a Denver Water Pressure Reducing Valve (PRV) building were opened on November 17, 2016 at 3:00 pm at the Town Hall. A total of four (4) bids were received and were as follows:
Michael Harrington of Lamont Engineers, PC discussed the bids and recommended awarding the base bid and go with a larger vault. Different options were discussed regarding the deducts and further discussed tank telemetry and bonding for all. The Town Board will meet with Roxbury Run Village Association’s Board to discuss the matter before a decision is made on awarding the bid. Supervisor Hynes will set up the meeting.
RESOLUTION #87-AUCTION HIGHWAY GARAGE GAS TANK
On motion of Gene Cronk second by Edward Raeder the following resolution was offered and adopted:
“RESOLVED, the Town Board authorizes the Highway Supt. to place the highway garage gas tank on Auctions International site for bids.”

“RESOILVED, a public hearing will be held before the Town Board for the Town of Roxbury at the Roxbury Town Hall, 53690 State Hwy 30, Roxbury, New York on the 12th day of December 2016, at 7:15 p.m., regarding the adoption of a proposed Local Law prohibiting the posting of signs on the Veterans Memorial Site located at the corner of State Route 30 and County Route 41, thereby preserving and enhancing the aesthetics of this property that is located in the Town by prohibiting the desecration of a Public Monument due to the posting of signs on said property. At such time and place all persons interested in the subject matter thereof will be heard concerning the same.”

A Public Hearing and regular monthly meeting of the Town Board was held November 10, 2016 at 7:00 pm at the Town Hall. Present were: Supervisor Thomas S. Hynes, Councilmen Gene Cronk, Edward Raeder, Allen Hinkley and Carol Murray, Dpty. Hwy. Supt. William Sprague and 1 resident. Absent were: Hwy. Supt. Neil German, Assessor Robert Breglio, Building Inspector William Walcutt and Attorney Kevin Young.
The Public Hearing on the 2017 Preliminary Budget was called to order at 7:00 pm. The notice calling for the hearing was read. Budget Officer, Carolynn Faraci explained three proposed changes to the budget that include: General Fund Appropriations #7510.4 Historian contractual increase from $500 to $1,000 and #3120.4 Constable contractual decrease from $30,000 to $17,000. General Fund Revenues #1081 PILOT decrease from $2,451 to $2,417 and #2770 Election Reimb. decrease from $8,520 to $8,450.
Discussion took place on needed repairs on the old highway garage but is for nominal costs. Supervisor Hynes reported the 2017 County budget is expected to increase approximately 2%.
With no other comments being made, the hearing closed at 7:15 pm.
The regular meeting was called to order at 7:20 pm.

Glenn Faulkner of MTC Cable updated the Town Board on the progress of expanding broadband service in the area where State grant funds will be used towards costs. 400 homes have just been hooked up and Denver valley is expected to be completed by year end. They are also in the process of submitting applications to the State for funding four other projects and are requesting a letter of support from the Town.
Steve Finch of MTC Cable reported that the 180 foot tower being installed in Grand Gorge is a little behind schedule but is moving along with the pinned rock anchor foundation being installed currently. The tower will be in partnership with the County for use as well. There is also a wireless provider very interested in signing on for cell service.
Supervisor Hynes questioned the building that MTC was to install in the Town parking lot. MTC reported it will be installed as part of the next phase of work. They will also check into the problems the Assessor’s office is having with the speed of their computers and issues with cameras at the park.
Dpty. Hwy. Supt. William Sprague requested putting the old gas tank at the highway garage on the Auctions International site to sell which no Board member was against, requested ordering the new truck now that is in the 2017 proposed budget and which the Board has no problem with ordering, stated having received one quote for stone & oil for the highway garage parking lot but will wait for a second quote and stated NYS DOT is requiring a resolution to confirm four Town roads for the purposes of CHIPS funding.
RESOLUTION #80-RESOLUTION FOR THE ADOPTION OF FOUR PUBLIC TOWN HIGHWAYS IN THE TOWN OF ROXBURY
On motion of Allen Hinkley second by Edward Raeder the following resolution was offered and adopted:
“WHEREAS; pursuant to §189 of New York State Highway Law, in order to establish a public town highway it must be demonstrated that the roadway has been kept in repair or taken in charge by public authorities for a period of ten years or more;
WHEREAS, the Town Highway Superintendent has advised the Town Board of the existence of four town roads that have been utilized as public highways and have been continually maintained by the Town Highway Department for a period of at least 10 years; and
WHEREAS, pursuant to New York State Highway Law, §140(8) Town Highway Superintendents are required to maintain an inventory that sufficiently describes and records highways in the Town Clerk’s office.
NOW THEREFORE BE IT RESOLVED that the Town Board hereby authorizes the Town Highway Superintendent to add the following dead end roads to the Town’s highway inventory pursuant to New York State Law:
1. Tom Hinkley Road (from Lower Meeker Hollow Road to dead end, a distance of .30 mile)
2. Eber Cartwright Road (from County Hwy 36 to dead end, a distance of .14 mile)
3 Fairway Drive (from Burroughs Memorial Road to dead end, a distance of .51 mile)
4. Shepard Lane (from Park Street to dead end, a distance of .14 mile)
WHEREUPON, the Resolution was put to a vote, and recorded as follows:

RESOLUTION #81-MTC CABLE SUPPORT LETTER
On motion of Gene Cronk second by Allen Hinkley the following resolution was offered and adopted:
“WHEREAS, MTC Cable (MTC) is preparing to submit four grant funding applications to the New NY Broadband Program; and
WHEREAS, the projects will include bringing broadband to new local areas and to upgrade existing lines to other local areas; and
WHEREAS, the Town supports the benefits of broadband availability;
NOW, THEREFORE BE IT RESOLVED, the Town Board, Town of Roxbury supports the applications being submitted by MTC to the New NY Broadband Program for four broadband projects in local communities.”

RESOLUTION #82-HIRE OLIVER FOR HIGHWAY DEPT.
On motion of Allen Hinkley second by Gene Cronk the following resolution was offered and adopted:
“WHEREAS, a vacancy exists in the Highway Dept.; and
WHEREAS, the Highway Supt. requests hiring Colin Oliver as a Heavy Equipment Operator (HEO);
NOW, THEREFORE BE IT RESOLVED, the Town Board hires Colin Oliver as HEO on the Highway Dept., full-time, effective 12/1/16 or after per Hwy. Supt., at the reduced pay rate of $18.25 per hour plus benefits.”

RESOLUTION #83-ADD TOWN OF HALCOTT TO SHARED SERVICES AGREEMENT
On motion of Gene Cronk second by Allen Hinkley the following resolution was offered and adopted:
“WHEREAS, the Town Board, Town of Roxbury, adopted a resolution on December 14, 2015 authorizing the Town of Roxbury Chief Executive Officer to sign a contract for shared highway services to permit the Town of Roxbury highway department head to share services with highway department heads in other municipalities; and
WHEREAS, said Shared Services contract included services with the Towns of Stamford, Town of Andes, Town of Harpersfield, Town of Middletown, Town of Gilboa, Village of Delhi and County of Delaware; and
WHEREAS, on December 29, 2015 the Town Board added NYS Dept. of Transportation (NYSDOT) to the Shared Services contract; and
WHEREAS, said Shared Services contract expires 12/13/20;
NOW, THEREFORE BE IT RESOLVED, the Town Board, Town of Roxbury, hereby amends the Town of Roxbury Shared Services Agreement to include shared services with the Town of Halcott; and
BE IT FURTHER RESOLVED this resolution shall take effect immediately.”

Parks Clerk Carolynn Faraci reported the dollhouse window sashes are expected to be completed next week, but due to being more labor intensive than originally thought, the cost will be $43 per sash compared to $32 as quoted. No Board member opposed the increase. Mrs. Faraci added the park bridge repairs should begin soon.
A report has been received from Lamont Engineers PC regarding the Denver Water work for tank telemetry and adding bids for the PRV building are scheduled to be opened November 17th at 3:00 pm at the Town Hall.

“RESOLVED, the Town Board schedules a Special Meeting to be held November 21, 2017 at 7:00 pm at the Town Hall to discuss Denver Water District issues and any other business that may come before the Town Board.”

Councilman Hinkley, having received a call from Building Inspector William Walcutt, discussed issues with the amount of fees to be charged to NYCDEP for upgrades/repairs to the Grand Gorge Sewer Plant building. Questions arise with what part of the work actually requires a permit. The Board’s decision was to have the Building Inspector get the plans/specs of the project from DEP before a decision on a fee can be determined. The matter was also discussed in a written report from the Town Attorney.
The Board also discussed issues with the Building Inspector taking unannounced vacations and no deputy to fill in for him. It was stated that his contract requires him to appoint a deputy, subject to Town Board approval, to make determinations in his absence. The Town Board made no decisions in the matter.

RESOLUTION #85-ADOPT 2017 TOWN BUDGET
On motion of Allen Hinkley second by Edward Raeder the following resolution was offered and adopted:
“WHEREAS, the Town Board has reviewed and discussed the 2017 Preliminary Town Budget; and
WHEREAS, the proposed changes to the 2017 Preliminary Budget include the following: General Fund Appropriations #7510.4 Historian contractual increase from $500 to $1,000 and #3120.4 Constable contractual decrease from $30,000 to $17,000. General Fund Revenues #1081 PILOT decrease from $2,451 to $2,417 and #2770 Election Reimb. decrease from $8,520 to $8,450.
NOW, THEREFORE BE IT RESOLVED, the Town Board adopts the 2017 Town Budget, which includes the changes listed above and authorizes the filing of same with the appropriate agencies.”

The Town Board thanked the Budget Officer for her work on the budget and added that the 2017 Town Budget stayed below the allowable tax cap levy for 2017.
RESOLUTION #86-UNPAID WATER BALANCES TO TAXES
On motion of Carol Murray second by Allen Hinkley the following resolution was offered and adopted:
“WHEREAS, pursuant to subdivision 3 of Section 198 of the Town Law, all unpaid water balances due and owing for the period ending September 30th of each year are to be paid by November 1st of that same year; and
WHEREAS, any unpaid water balances for the period ending September 30th shall be added to the taxes levied for the next year; and
NOW, THEREFORE BE IT RESOLVED the Town Board authorizes the unpaid water balances due and owing through the period ending September 30, 2017 be added to the taxes to be levied for the year 2017 in the following amounts: Denver Water $1,581.80; Grand Gorge Water $9,884.20 and Roxbury Water $4,064.96.”

Attorney Kevin Young was absent but submitted a written report for the Town Board including:
NYCDEP Collection System Assessment-Atty. Beebe has submitted the appraisal figures to DEP who is in the process of reviewing them to decide if they will withdraw their action.
Building Inspector-same issue as discussed earlier regarding a proposed NYCDEP building permit application.
Signs at Veteran’s Memorial-a draft Local Law was distributed to the Town Board to review and decide if they want to proceed with a public hearing.
GEIS Project-a proposed amended application has been submitted to CWC and is currently also being reviewed by DEP.
Grand Gorge Tire Sewer Hookup-the owner can apply for funds through CWC to cover costs with 100% of costs to be paid if DEP decides to eliminate the local match on the Business Septic Fund.
Supervisor Hynes stated he has spoken with the Tax Collector regarding the April 2016 bank interest and we should expect a check from her in a couple of days.

Rich Davis of the Grand Gorge Community Action Group stated their group will be holding the annual Halloween Party at the Civic Center on October 29th 2:00 pm – 4:30 pm and all are invited.
Assessor Robert Breglio provided a written monthly report for the Town Board and reported the following: there are issues with the new STAR check program where only Basic Star amounts were sent to several Enhanced eligible owners so additional checks will be sent to make up the difference, he has been visiting new building permit sites for valuation on next year’s roll and discussed the question by Supv. Hynes of whether a carport is assessable or not stating his determinations rests on permanency of the structure as installed/built.
Attorney Young discussed the Chazen report for assessment value of NYC DEP’s Grand Gorge sewer collection system. It has come in at $10M, higher than in the past, and negotiations will take place with DEP on how to make up the difference. The Town Board was agreeable with Attorney Beebe taking the Town Board’s offer to DEP.
Highway Supt. Neil German stated crews are replacing sluice pipes, cleaning ditches, brush cutting and getting ready for winter, stated the items placed on Auctions International for sale have come in as follows: 1972 tractor with mower $3,700 and the old highway garage lights $62.50, he requested hiring Colin Oliver to start 12/1/16, repairs need to be made to the water truck and some road signs need to be replaced.
Supv. Hynes reported a leak at Denver Water has been repaired and further discussed the need for upgrading the pressure reducing valve in the district. Depending on whether the Town Board installs one or two valves, the two valves being recommended by the engineer, the cost would be $25,000 – $35,000 and a bond would be required to pay for it.

LVDV Operations, Inc. has made a personnel change for the water/sewer operator, therefore, Dan Sperbeck is no longer the operator. Mike Jonker will fill in until said time when a permanent operator is named.
Parks Clerk Carolynn Faraci reported there is one more event scheduled this month in the park and then the restrooms will be winterized and plans are to decorate four large round hay bales in the hamlet for Halloween with the hay bales being donated by Dickie Perry.
Supv. Hynes reported the leaking hot water tank at the Civic Center has been replaced, the gym floor will be sealed by Alan Davis of Roxbury School and concrete work at the Transfer Station is expected to be completed next year. The swings at the Civic Center playground will also be lowered, which Grand Gorge Community Action Group members have offered to do for the Town.
Copies of the 2017 Tentative Town Budget were distributed to the Town Board on September 30, 2016. A reminder was given a Budget Workshop on the 2017 Tentative Budget is scheduled for October 17, 2016 at 7:00 pm at the Town Hall.
A Dog Control Officer inspection was conducted by State Ag & Markets and has shown all items to be satisfactory.
Supv. Hynes reported receiving a price for replacing the fence at the Civic Center ball field in the amount of $9,500. No decision was made.

A Special Meeting of the Town Board was held October 17, 2016 at 7:00 pm at the Town Hall to conduct a budget workshop and to hear any other business to come before the Board. Present: Supervisor Thomas S. Hynes, Councilmen Gene Cronk, Edward Raeder, Allen Hinkley and Carol Murray, Hwy. Supt. Neil German, Dpty. Hwy. Supt. William Sprague, Budget Officer Carolynn Faraci and four residents.
Michael Harrington of Lamont Engineers, PC updated the Town Board on the status of the Denver Water District project work that has been submitted for Drinking Water State Revolving Fund monies (DWSRF) in the amount of $1M where the District would be responsible for 40% of costs. A summary of work and costs was distributed to the Town Board. One of the items submitted is to install a new Pressure Reducing Valve (PRV) building to house two valves. Since the current PRV is not sufficient to handle the water pressure it is warranted to install the new valves now. The Town Board would also like the engineer to look into costs to install an alarm on the water tank to notify of a low water level as it is desperately needed as soon as possible. Harrington discussed the bidding process for the PRV building. He also recommends applying for water grant funding as well.

Harrington reported Grand Gorge /Roxbury Water project is estimated at $3.5M for DWSRF grant funding and feels it should score well for funding which would be a 40% cost to the Districts. A summary of work and costs was distributed to the Town Board. The Town Board has decided to hold off on SEQRA work for now and the Hinkley property purchase is on hold as well until outcome of grant funding. Part of the work under the application is filtration of the springs to which the Town Board authorizes Lamont Engineers, PC to prepare a plan for and submit to NYS Dept. of Health now.
Councilman Raeder questioned the costs for tank controls & generator cost differences between the Denver Water and Grand Gorge/Roxbury Water projects. Harrington will look into the matter.
Budget Officer Carolynn Faraci stated the current 2017 Tentative Budget is well under the tax cap levy of .68%.
Councilwoman Murray questioned the General Fund Constable contractual line that will be looked into further by the Budget Officer for response.
A change was made to Roxbury Sewer for the amount to raise by tax being $41,471.70 per the DEP approved budget and rate formulas.
No changes were made to any salaries in the Tentative Budget.
Supervisor Hynes reported the County Budget is currently expected to increase 3% but it is being worked on to lower it.
The Town Board again discussed the Auctions International high bids for the 1972 Ford tractor with mower at $3,700 and the old lights from the highway garage at $62.50.

Two Public Hearings and the regular meeting of the Town Board were held September 12, 2016 at 7:15 pm at the Town Hall. Present were: Supervisor Thomas S. Hynes, Councilmen Gene Cronk, Edward Raeder, Allen Hinkley and Carol Murray, Dpty. Hwy. Supt. William Sprague, Assessor Robert Breglio, Parks Clerk Carolynn Faraci, Attorney Kevin Young and 2 residents. Absent: Hwy. Supt. Neil German (due to illness) and Building Inspector William Walcutt.
The Public Hearing for closeout of the 2012 Community Development Block Grant (CDBG) was called to order at 7:15 pm. The notice calling for the hearing was read. Margaret Ellsworth of the M-ARK Project Inc. discussed the project that funded 18 housing rehabilitation projects in the Town of Roxbury. The total cost including administration fees was in the amount of $400,000.
No comments were heard in favor of or against closeout of the program.
The Hearing closed at 7:22 pm.
Four additional residents arrived.
The Public Hearing for comments on submission of an application to NYS Homes and Community Renewal for a new CDBG for housing rehab was called to order at 7:25 pm. The notice calling for the hearing was read. Margaret Ellsworth discussed the program and recommends submitting for only a $200,000 grant for 6-8 projects as there were only a few homeowners that were not able to be served by previous program funds. Maureen Sauveur expressed concerns with the homeowner application process and getting put on a waiting list. Ellsworth will look into the matter. Town Board members spoke in favor of submitting another application. No comments were heard against submitting the application.

One additional resident arrived.
William and Patricia Davis were present to discuss issues they have with property they purchased next to their home in Grand Gorge. They purchased the property from Federal National Mortgage Assoc. in March of 2016 for $4,500 and removed the house in May 2016. Issues pertain to the house having been condemned and notice posted by the Building Inspector in 2013 and currently having an assessed value of $44,800 that they were unaware of upon the purchase and that they will now be responsible for paying 2016 School Tax and 2017 Town/County taxes on. Assessor Robert Breglio upheld his assessment referencing Real Property Tax Law as it pertains to the house still standing as of March 1, 2016 (taxable status date), conditions of the structures, value of the primary acre with municipal water and sewer and that the Building Inspector had stated at an October 2015 Town Board meeting that the property was now in acceptable condition to him per his inspection. Breglio also added the owner’s were aware of the Grievance process having been in to speak with him regarding their primary residence assessment and further stated the assessment on the new property will decrease on March 1, 2017 due to the house being removed and will only reflect the primary acre and garage unless the owners decide to combine the two properties for taxable purposes which would further remove the second primary acre value. Attorney Young agreed with the Assessor’s interpretation of the tax law regarding the matter. The Davis’s also had issues with the Building Inspector not returning calls and not responding with requests for copies of building permits and plans that would now make the property condition acceptable. The Town Board will contact the Building Inspector regarding the issues raised and to attend the next meeting to discuss the matter further.
Assessor Robert Breglio spoke about items from his written report to the Town Board including issues with people not getting building permits for required work and therefore the Assessor not knowing about the work until viewing changes on real estate sale listings. He also discussed issues with the STAR check program that is now being administered by the State.
Attorney Kevin Young stated having received a report from Chazen regarding NYCDEP sewer collection system values. The matter will be discussed further at a later date for future assessments.
Highway Supt. Neil German was absent but Deputy Hwy. Supt. William Sprague reported stone and oiling for this year has been completed, the Hwy. Supt. would like to post an old tractor with mower and old garage light fixtures for sale on the Auctions International site, requested the Town sell the carriages being stored at the old highway garage because they have not been used in several years and it would clear storage space for highway materials/equipment, the Highway Supt. is requesting Ralph Sprague to fill the Highway Mechanic vacancy and they are waiting on the rest of the parts to fix the truck damaged by the Town of Middletown.

“RESOLVED, The Town Board authorizes the Highway Supt. to post the 1972 Ford 2000 tractor & mower and the highway garage halogen light fixtures for sale on the online Auctions International site to obtain bids for same.”

WHEREAS, Ralph Sprague currently holds the position of Mechanic’s Assistant;
NOW, THEREFORE BE IT RESOLVED, the Town Board appoints Ralph Sprague from Mechanic’s Assistant to the position of Mechanic effective September 13, 2016 at a rate of pay of $21.22/hour.”

Dpty. Supt. Sprague requested filling the current vacancy in the Highway Dept. He was directed to have the Hwy. Supt. make his recommendation to the Town Board.
Parks Clerk Carolynn Faraci reported there are still four events booked for the pavilion this year, has six events already booked for next year, the flower boxes on Main Street will soon be getting filled with mums and stated the dollhouse windows are still out being repaired.
Brian Perazone expressed concerns with event signs being posted on the Veterans Memorial property and requested the Town Board enact a law with penalties that would prevent such posting. The Attorney will look into doing a local law on the matter.
Supervisor Hynes stated the water running across the pony farm driveway in Grand Gorge was due to an open valve on the old Frevert Well waterline. The valve has been shut off.
Supervisor Hynes also reported a leak still exists on the Roxbury waterline in between the school and Benecke residence and is expected to be repaired soon.
Attorney Young is still awaits a response from NYCDEP regarding costs for Grand Gorge Tire to hook up to the Grand Gorge DEP sewer line.

“WHEREAS, in 2012 the Town of Roxbury was awarded a Community Development Block Grant (CDBG) Project #1004HR64-12 for owner occupied housing rehabilitation from NYS Homes and Community Renewal in the amount of $400,000; and
WHEREAS, the program was administered by the M-ARK Project, Inc. on behalf of the Town of Roxbury; and
WHEREAS, all work was completed and final funds were dispersed in October 2015; and
WHEREAS, funds were dispersed to eighteen homeowners in the amount of $351,000 and for administration in the amount of $49,000; and
WHEREAS, a Public Hearing on closeout of the program was advertised in the Catskill Mountain News; and

To apply for the County Clean Sweep Program for hazardous wastes applicants must register with the program through September 15, 2016.
A Tire Day has been scheduled for October 15, 2016, 8:00 am -4:00 pm at the Roxbury Highway Garage. It is being done jointly with the Town of Middletown. Requirements for use: Town of Roxbury or Town of Middletown residents only, Transfer Station Permit required, will take tires fitting up to 17” wheels, rims must be removed and a limit of 10 tires per household.
Attorney Young stated Attorney Beebe acknowledges that he will receive no payment for the NYCDEP collection system assessment work until completed and the Town Board accepts the terms of the agreement.
Joseph Resch requested the Town Board have the Civic Center gym floor refinished and to have the gym repainted the original school colors of green and white. Supervisor Hynes will check with Alan Davis of Roxbury School regarding the matter on what materials to use on the floor.
Sam Maniscalco’s car received bumper and gas tank damage from stones that came from a Town of Roxbury dump truck when the tailgate opened unknowingly to the truck driver. Attorney Young was directed to prepare General Release papers for the car owner to sign, based upon his copies of estimates, and the Town will pay the damages outright to the owner.

The regular meeting of the Town Board was held August 8, 2016 at 7:30 pm at the Grand Gorge Civic Center. Present: Supervisor Thomas S. Hynes, Councilmen Gene Cronk, Edward Raeder, Allen Hinkley and Carol Murray, Assessor Robert Breglio and 6 residents. Absent: Highway Supt. Neil German and Attorney Kevin Young.

The regular meeting of the Town Board was held August 8, 2016 at 7:30 pm at the Grand Gorge Civic Center. Present: Supervisor Thomas S. Hynes, Councilmen Gene Cronk, Edward Raeder, Allen Hinkley and Carol Murray, Assessor Robert Breglio and 6 residents. Absent: Highway Supt. Neil German and Attorney Kevin Young.

Margaret Ellsworth reported the grant application for the Grand Gorge Civic Center work has been submitted for a Community Development Block Grant (CDBG) and should hear if awarded or not in December, a grant has been submitted for repairs to the north tower of the Gould Church, an audit was performed by the State on the CDBG housing rehabilitation grant with no major issues found, a public hearing must be held to close out the CDBG housing rehab grant and will be scheduled for Sept. and Katie Camillone was acknowledged for her good work on the CDBG housing rehab project. Peg also suggested the Town apply again for another CDBG housing rehab grant as there was interest last time from residents who were too late for the program funds. Joe Resch questioned possibly getting historic preservation grant funds for Civic Center repairs due to the building being historic. Peg discussed the matter.
Parks Clerk, Carolynn Faraci reported events for Sept. 4th of Labor Day weekend include a concert and fireworks in the park at 6:00 pm and 8:30 pm respectively, Hinkley electric will look more into installing additional lights in the park, the park bridge repairs should be completed in September, a new girl has started work as part of the summer youth program in the park and Town Hall and stated the youth program staff this year has done an excellent job. Discussion took place on the recent vandalism to the park dollhouse, possibly boarding up the building so no other damage could occur, and removing a problem tree. The Town Board decision was the dollhouse would not be boarded up because now that cameras are there they should be a deterrent for future damage. The Town is still waiting for information from the State regarding the community kitchen.
Robert Breglio submitted a written monthly report to the Town Board and stated a summer youth intern has been working in the Assessor’s office with filing, etc, the State has been more forthcoming with information on the new STAR Check program, he has not had any more problems with the Real Property data base since the County finally updated the State file from Sept. 2015 and he continues to work on the 2017 roll changes and expects field work to be completed in October. Mr. Breglio also discussed issues with Roxbury School who is upset with the Town’s agreement with the County where the School would only get 25% of proceeds from PILOT Programs on commercial solar farms. To date, no applications have been received for a commercial solar farm. It was stated the breakdown, Town 50%, County 25% and School 25% was decided because the Town would have to do most of the work pertaining to solar farms.
Supv. Hynes reported in the Grand Gorge Water District on the service line of Sean Smith who plans to repair his own line and chlorine has now been found in the constant stream of water running across the driveway of the mini horse barn that appears to be an old valve from the Frevert well line.
The Town Board discussed repairs to a sewer line servicing Roxbury Run Village #8-2 that was backing up into the unit. The owner is requesting mold remediation and cleanout of his crawl space that still contains small amounts of sewage. Lime will be spread and further cleanout will be looked into.
Repairs to the building at the Transfer Station have been completed. Concrete work is expected to be completed in the fall. Councilman Hinkley will schedule the concrete work with B&B Construction.
Highway Supt. Neil German was absent because he was meeting with Soil & Water personnel regarding issues on Johnson Hollow Rd. He submitted a written report for the Board which includes: stone and oil is almost completed for the year, Ed Docskalik’s last day of work will be August 25, 2016 due to retirement, damage to a Roxbury truck in the estimated amount of $24,604 will be paid for by the Town of Middletown who caused the damage, he is okay with the bid submitted for the 1979 International truck and all high bids submitted to Auctions International for sale of several pieces of equipment.
A letter was received from Edward Docskalik stating he will be retiring and his last day of work will be August 25, 2016.
RESOLUTION #56-DOCSKALIK RETIREMENT
On motion of Allen Hinkley second by Carol Murray the following resolution was offered and adopted:
“WHEREAS, the Town Board has received a letter from Edward Docskalik, Mechanic, stating he will be retiring with his last day of work to be August 25, 2016; and
WHEREAS, Mr. Docskalik has 15+ years of full-time service with the Town of Roxbury; and
WHEREAS, per the highway contract, full-time employees with 15+ years of service retiring at the age of 62 shall be covered by the Town’s health/dental insurance until the age for Medicare (currently being 65 years of age);
NOW, THEREFORE BE IT RESOLVED, the Town Board accepts the retirement of Edward Docskalik effective August 25, 2016; and
BE IT FURTHER RESOLVED, the Town Board shall cover the cost of his health/dental insurance until the age for Medicare (currently 65 years of age).”

Supv. Hynes stated he and Mike Harrington of Lamont Engineers met with Roxbury Run Village Association board members to discuss some of their concerns with Denver Water and Sewer operations and issues. Mike Harrington of Lamont Engineers P.C. discussed a proposed grant funding application for work on the Denver Water system to address issues with lines, valves and tank control system. Lamont Eng. proposes doing a study and cost estimate of work at a cost of $5,000 so an application can be submitted by Sept. 2nd. Discussion also took place on needed repairs and upgrades for the Denver Sewer system. Supv. Hynes will look into Catskill Watershed Corp. (CWC) funding and Mike Harrington will look into NYCDEP funding for infrastructure repairs. Previous operator John Sanford will be contacted to assist Lamont Eng. with marking locations of said items to be worked on as there are no maps available for the system.
RESOLUTION #57-LAMONT ENG. DENVER WATER DISTRICT STUDY
On motion of Gene Cronk second by Edward Raeder the following resolution was offered and adopted:
“RESOLVED, the Town Board accepts the terms of the proposal from Lamont Engineers, PC for engineering and planning services related to preliminary engineering and funding applications for the development of a Water System Improvement Project for the Denver Water District at a cost of $5,000 as initial work authorization.”

Discussion also took place on proposed land acquisition and infrastructure repairs in the Grand Gorge and Roxbury Water Districts. The Town would like to use the Assessor’s value of the land needed as we have gone to 100% values unless the owner would rather have a formal appraisal. Supv. Hynes and Mr. Harrington will meet with the property owner to further discuss the matter. The infrastructure repairs would also require the services of a hydro geologist. Lamont Eng. was directed to continue with the funding application for Roxbury and Grand Gorge water that is due Sept. 2nd. Harrington recommended holding a workshop to discuss all work to be submitted for a total price.
Harrington gave an update on getting the Roxbury springs back into use for Roxbury and Grand Gorge Water District use. NYS Dept. of Health (NYSDOH) required one year of testing to determine if the springs were under the influence of groundwater. That testing has been completed but DOH is now requiring special testing for spikes in the data for once in the spring and once in the fall. Therefore, it will be another year before knowing if the springs can be used again or not. The other alternative would be to filter the springs which would also involve additional testing during operation. Harrington will discuss the possible options further with DOH.
A letter was received from Ellen Wong requesting that she be allowed to hook up to the Roxbury Sewer. Her residence is already in the water district but is not in the sewer district. The Town will submit a request for sewer hookup to NYC DEP on her behalf.

A Public Hearing and regular meeting of the Town Board were held July 11, 2016 at 7:15 pm at the Town Hall. Present were: Supervisor Thomas S. Hynes, Councilmen Gene Cronk, Edward Raeder, Allen Hinkley and Carol Murray, Highway Supt. Neil German, Assessor Robert Breglio, Parks Clerk Carolynn Faraci, Attorney Kevin Young and 2 residents.
The Public Hearing was called to order at 7:15 pm. The notice was read calling for the hearing regarding a proposed grant application to NYS Homes & Community Renewal under a Community Development Block Grant Program for repairs and renovation work at the Grand Gorge Civic Center. Margaret Ellsworh discussed the project which includes windows, repairing the roof over the cafeteria, reconstruction of the main entrance to make it more energy efficient and accessibility issues. No comments were heard from the public for or against the project.
The Public Hearing closed at 7:26 pm.
The regular meeting was called to order at 7:30 pm. Two additional residents arrived.
The Minutes of the June 13, 2016 meeting were approved on motion of Allen Hinkley second by Carol Murray.

Joseph Resch thanked the Town Board spreading new mulch on the Civic Center playground and expressed concerns with kids are using lighters to burn the insides of the playground equipment, issues with full garbage cans at the playground, kids using the gym are leaving it a mess, requested the swings be lowered, reported the fence at the ball field requires fixing and requested signs be posted as a Smoke Free / Drug Free zone. The Board will have the Constable check the ball field more often and will look into the other matters discussed.
Assessor Robert Breglio gave a written report to the Town Board and reported the following items: the 2016 Final Assessment Roll was filed with the Town Clerk on July 1, the rescheduled Grievance Day was held June 16th where only a few applications were received, the Board of Assessment Review (BAR) was made up of County personnel including the Board of Supervisor’s Chairman, the Board of Supervisor’s Clerk and the Treasurer as the Town’s Board of Assessment Review did not have a quorum due to illness and vacation, the Assessor had given the BAR write-ups on all applications and, except for one, reductions were given to all, stated the notice for 2017 Grievance Day will include Grievance Day and adjourned hearing dates and requested the Town Board consider going to a 5 person BAR in the future to avoid what happened this year. Mr. Breglio also discussed concerns with the new STAR Check program.
Highway Supt. Neil German stated crews have been stoning & oiling, mowing, readying roads for work, stated the cameras at the garage have been installed, stated the blacktop driveway at the garage will need to be sealed next year and an employee is out on medical leave. Councilman Hinkley requested repairs be looked into on the Kirkside Park driveway.
Parks Clerk Carolynn Faraci stated the summer youth crew has begun work in the park, she may be getting 2 more kids for the youth program, 100 boy scouts will be using the park for a picnic this week on their way through Roxbury and she may be refunding a park renter for non-use due to extenuating circumstances.
Supv. Hynes stated a sewer line break was repaired in the Denver Sewer District and warned of a high cost of repair due to having to trace the line out slowly as the lines were laid out strangely and care had to be taken with electric and phone lines. No maps were available showing where lines were.
Shawn Smith, who incurred a large water line service break earlier this year that the Grand Gorge Water District had repaired and paid for, requested to be able to make payments over the next couple of years instead of by November 1, 2016. The Board did not change the requirement of being paid by November 1, 2016 and any balance will be placed on the taxes.
A letter was received from William & Patricia Davis regarding a water bill they received for property that they purchased from Fannie Mae. The Town Board discussed the matter and the Town Attorney will further look into the matter and will respond to the Davis’s.

“WHEREAS, the Town Board of the Town of Roxbury desires to make general repairs and renovations to the Grand Gorge Civic Center, including in-kind replacement of windows, roof repair, and redevelopment of entrance to improve accessibility (“Action”); and
WHEREAS, the Town Board of the Town of Roxbury has reviewed a Short Environmental Assessment Form (EAF) pursuant to the mandates of the State Environmental Quality Review Act (ECL Article 8 and 6 NYCRR Part 617); and
WHEREAS, the Town Board considered an Environmental Assessment Form (“EAF”), carefully considered the criteria set forth in 6 NYCRR 617.7; and
WHEREAS, the Town Board has considered all the questions in Parts 1 and 2 of the EAF, and has determined that the EAF identified and addressed all areas of concern and none of the potential environmental impacts associated with the proposed Action are significant.

An inspection was conducted by NYS Ag & Markets on the Heart of the Catskills Humane Society building in June 2014. The inspection report was distributed to the Town Board and no problems were found.
The Transfer Station will be closed Wednesday July 13th to undergo repairs. Notices have been posted at the Station and advertised in the paper.
Attorney Young discussed the status Grand Gorge Tire’s request for sewer hookup where we are now trying to get CWC to pick up 100% of the cost.
An annual audit has been conducted by the CPA’s for the year 2015 and no problems were found. A final copy of the audit will be on file at the Town Clerk’s Office when received.

A Public Hearing and regular meeting of the Town Board were held June 13, 2016 at 7:15 pm at the Town Hall. The regular meeting of the Town Board was called to order at 7:30 pm.

A Public Hearing and regular meeting of the Town Board were held June 13, 2016 at 7:15 pm at the Town Hall. Present were: Supervisor Thomas S. Hynes, Councilmen Gene Cronk, Edward Raeder, Allen Hinkley and Carol Murray, Assessor Robert Breglio, Parks Clerk Carolynn Faraci, Attorney Kevin Young and 11 residents. Absent: Highway Supt. Neil German.
The Public Hearing regarding draft Local Law #1-2016 Flood Prevention Law was called to order at 7:15 pm. The notice of the Public Hearing was read. Attorney Young stated the purpose of the law being for the Town to continue to be eligible for FEMA funds and added the law would restrict building in the flood plain. No one commented on the law but Charles Serrie requested to look at the proposed flood map regarding the Conro property in Grand Gorge where he determined it was not in the flood zone.
The hearing closed at 7:25 pm.

Bill Morton conducted a presentation on the Adirondack Scenic Byway that would connect the Adirondack Trail to the Catskill Trail system. The byway would include the State Hwy 30 and 30A corridors and would be a positive designation on communities for promotion of businesses in along the byway via tourism. Discussion took place on pros and cons and on the input and responsibilities of the towns and villages which will also require approval from State DOT. Carol O’Beirne of the Catskill Mountain Scenic Byway offered support of the project and Margaret Ellsworth offered to represent the Town on the steering committee. Attorney Young questioned if an inter-municipal agreement would be required to which it was stated individual agreements with each town/village will be required.
Assessor Robert Breglio gave a written report to the Town Board. Discussion took place on the STAR program changes, Grievance Day has been re-scheduled for June 16, 2016 4-8 pm due to not having a quorum on May 26, 2016 and added, per the law, the Board of Assessment Review will consist of the County Board of Supv. Chairman, County Board of Supv. Clerk and County Treasurer. Applicants that had submitted Grievance forms for the May grievance have been notified of the June grievance day. Breglio also added the EQ Rate is staying at 100%.
Margaret Ellsworth requested a public hearing for the CDBG application of grant funds for the Grand Gorge Civic Center, stated the planning committee is getting started on the plans for the community kitchen that will be housed in the north barn of the park and reported the kiosk signs will be ready in two weeks.
RESOLUTION #45-SCHEDULE PUBLIC HEARING ON GG CIVIC CENTER CDBG APPLICATION
On motion of Carol Murray second by Edward Raeder the following resolution was offered and adopted:
“WHEREAS, The Town of Roxbury intends to apply for up to $600,000 in financial assistance to NYS Homes and Community renewal via a 2016 Consolidated Funding Application under the Community Development Block Grant program for public facilities; and
WHEREAS, said funds are to be used for improvements to the Grand Gorge Civic Center,
NOW, THEREFORE BE IT RESOLVED, The town of Roxbury authorizes the MARK Project to apply for up to $600,000 in financial assistance to NYS Homes and Community renewal via a 2016 Consolidated Funding Application under the Community Development Block Grant program for public facilities, with funds to be used for improvements to the Grand Gorge Civic Center; and
BE IT FURTHER RESOLVED a public hearing is called for July 11, 2016, at 7:15 at the Roxbury Town Hall to solicit public comment and input to this application process.”

Parks Clerk Carolynn Faraci reported the dollhouse windows are in Oneonta being repaired and the park building is booked through the beginning of August.
Cherie Serrie questioned why the Conro property was not taken out of the hamlet designation. It was stated because it is a large parcel in the center of the hamlet.
Richard Davis of the Grand Gorge Community Action Group (GGCAG) requested Town Board support for an application for grant funds to purchase additional chairs and tables for the Civic Center as it is being used more. The Town Board had no objections and suggested he speak with Peg Ellsworth for grant information. He also stated the group has discussed having a carnival on the ball field. The Town Board expressed concerns with noise, lights, parking, emergency vehicle access, etc. and requested more information from the group. Davis also commented how nice the field has been taken care of. The Town will be removing the excess dirt and old soccer goals.
Supv. Hynes stated the water leak on Ridge Rd. Spur has been repaired and is at the cost of the District as it was at the main.
Steve Cammer is to begin work at the Transfer Station on July 12th after the noon closing so it will be closed on Wednesday July 13th as well. Councilman Hinkley will contact B&B Construction to see if they can do the concrete work at the same time.
Highway Supt. Neil German was absent but requested that he sell some highway equipment on an auction site and requested approval to dispose of the old refrigerator at the garage.
RESOLUTION #46 – LIST HIGHWAY EQUIPMENT TO SELL ON AUCTION SITE

“RESOLVED, the Town Board authorizes the Highway Supt. to list the following equipment for sale on the Auctions International site: 2001 Ford F550 pickup, 2004 Chevrolet 3500 pickup, 1979 International Dump Truck and Lincoln welder.”

RESOLUTION #47- RESOLUTION OF THE TOWN BOARD OF THE TOWN OF ROXBURY DETERMINING THAT THERE ARE NO ADVERSE IMPACTS ON THE ENVIRONMENT FROM ADOPTION OF THE FLOOD DAMAGE PREVENTION LAW
On motion of Allen Hinkley second by Gene Cronk the following resolution was offered and adopted:
WHEREAS, the Town Board is adopting a local law that repeals and supersedes Local Law No. 1 of the year 2012 entitled “Flood Damage Prevention” in order to maintain the community’s eligibility to participate in the National Flood Insurance Program (“NFIP”);
WHEREAS, the possible environmental impacts of the adoption of this Law have been considered by the Town Board;
NOWTHEREFORE BE IT RESOLVED, that the Town Board has determined that the adoption of new local law entitled “Flood Damage Prevention Law” will not have significant adverse impacts on the environment; and

WHEREAS, the Town Board adopted a resolution on May 9, 2016 scheduling a public hearing on the proposed Local Law No. 1 of 2016;
WHEREAS, the public hearing was properly noticed in the Town’s official newspaper on May 25, 2016;
WHEREAS, the public hearing on the proposed Local Law was held on June 13, 2016 at the Town Hall;
WHEREAS, the Town Board reviewed and considered all public comments received on the proposed Local Law;
WHEREAS, the proposed Local Law was on file for inspection at the Town Clerk’s office prior to the hearing and during the public review process;
WHEREAS, the proposed Local Law maintains the Town’s eligibility to participate in the National Flood Insurance Program (“NFIP”) and serves to strengthen and protect the Town’s environmental resources, public safety, health and welfare;

Attorney Young stated he is still waiting for a written response from NYC DEP regarding Grand Gorge Tire sewer hookup. CWC will pay 75% of the cost and the Town has requested that NYCDEP pay 25%.
Supervisor Hynes stated a new vehicle for the Constable is available in Binghamton. The lights and radio will need to be installed.

“RESOLVED, the Town Board approves the purchase of a 2016 Chevrolet Tahoe as a Constable Vehicle on State bid from Matthews Auto at a cost of $39,199.89; and
BE IT FURTHER RESOLVED, per the 2016 Town Budget, the Town Board directs the Town Clerk to request NYCDEP approval to use Good Neighbor Funds in the amount of $32,000 towards the cost of the vehicle; and

Town Board Approved Meeting Minutes - May 9, 2016
The regular meeting of the Town Board was held May 9, 2016 at 7:30 pm at the Town Hall. Present: Supervisor Thomas S. Hynes, Councilmen Gene Cronk, Edward Raeder, Allen Hinkley and Carol Murray, Highway Supt. Neil German, Attorney Kevin Young & 7 residents.

May 9, 2016
The regular meeting of the Town Board was held May 9, 2016 at 7:30 pm at the Town Hall. Present: Supervisor Thomas S. Hynes, Councilmen Gene Cronk, Edward Raeder, Allen Hinkley and Carol Murray, Highway Supt. Neil German, Attorney Kevin Young & 7 residents.
The Minutes of the April 11, 2016 regular meeting were approved on motion of Gene Cronk second by Allen Hinkley.

Robert Allison and Rick Woidt were present to discuss the revised flood study maps for the hamlet of Grand Gorge under the GEIS Project that were modified after the March Public Information meeting and further elevation studies. Issues discussed include restricted water flow at the bridge on State Hwy. 30 due to the water line in the stream, approving and filing the study map with FEMA, flood insurance rates and mitigation measures for the trailer park and the water line in the stream. The Town Board must decide whether or not they will approve the flood study maps to be turned into FEMA. The Board would like to discuss the matters presented with Nicole Franzese of the Delaware County Planning Dept. before making a decision on the flood study map.
Carol O’Beirne was present to discuss the East Branch Delaware River Recreation Access Plan. Binders were distributed to the Town Board at the April meeting for review and feedback. The plan reflects recreational concepts specific to each town & village in Delaware County that includes water use, trails, fishing, etc. Municipalities would be able to obtain funding for projects and help is available for creating an information kiosk. Four projects are currently planned throughout Delaware County under the program. A Stewardship Program is also underway for each community using their own people. The program also welcomes community feedback.
Highway Supt. Neil German reported crews are cleaning ditches and patching holes and added they have finished Carr George Rd. Discussion took place regarding the sand pile and Item 4 pile running into the nearby stream. A block wall will be built to prevent further run off. The Hwy. Supt. was approved to purchase blocks for the retaining wall at $62/block. The Hwy. Supt. and Councilman Hinkley have also met with ZS Security for installing cameras at the highway garage and a quote has been received for same in the amount of $6,334.86.
RESOLUTION #38 –APPROVE CAMERAS FOR HIGHWAY GARAGE
On motion of Gene Cronk second by Allen Hinkley the following resolution was offered and adopted:
“RESOLVED, the Town Board approves the quote of ZS Security to install eight (8) cameras and necessary apparatus at the highway garage in the amount of $6,334.86.”

Assessor Robert Breglio submitted a written report to the Town Board for April 2016. Assessor Clerk, Stephanie Seminara was present to discuss some of the items reporting the Town should be receiving State reimbursement soon for the re-valuation in the amount of $12,000 +/-, STAR changes for new applicants this year will be that approved applicants will have to apply to State Taxation & Finance under the “STAR Check” program, where if approved as eligible, they would have to pay the full school tax bill and then receive reimbursement from the State for the STAR amount which will also be reportable on the owners income tax. There will be no changes for existing Basic or Enhanced STAR owners or existing Basic STAR owners that upgrade to the Enhanced STAR due to age.
Parks Clerk, Carolynn Faraci reported getting two quotes for repair of the glass in 21 window sashes broken out in the Kirkside Park dollhouse building and are as follows: Tri-County Glass $100/sash and Ace Glass $36/sash, renovations in the north barn for the Community Kitchen is expected to begin next year, several more plaques have been ordered for Roxbury Historic District homes that will be paid with owner and grant funds and will be installed by Gary Faraci at no cost to the owner, 30 cedar planters are expected to be distributed on Main Street Roxbury under a community sponsorship program with additional funds being sought through Go Fund Me and stated one of the park bridges is expected to be replaced in late summer.
Supv. Hynes reported Roxbury Water PW-1 has experienced a decrease in pumping capacity from 180 gpm to 130 gpm. Titan Drilling has replaced a broken pipe and will also replace the pump.
A letter was received from Dennis Slater requesting to hook up one of the trailers in his trailer park to the Grand Gorge Water District line in Hubbell Corners due to rising Dept. of Health testing costs. Mr. Slater stated he would like to hook up all five trailers in that section but the water charges (ad valorem and usage charges) would be $3,000/year. He is planning to subdivide his park to break off the one trailer for water. All trailers in the park are hooked to municipal sewer.
RESOLUTION #39- RESOLUTION OF THE TOWN BOARD OF THE TOWN OF ROXBURY CONSENTING TO ALLOW ONE TRAILER LOT IN THE D & J TRAILER COURT TO CONNECT TO THE GRAND GORGE WATER DISTRICT
On motion of Allen Hinkley second by Gene Cronk the following resolution was offered and adopted:
“WHEREAS, the Town of Roxbury adopted its existing “Water Use Law” (“WUL”) in November of 2012; and
WHEREAS, the Town Board has received a request for permission for one trailer lot in the D&J Trailer Court (the “Trailer Park”), known as Lot # 1 (“Lot #1), to Connect to the Town’s Grand Gorge Water District; and
WHEREAS, according to the Town of Roxbury’s WUL the Trailer Park could connect Lot #1 to the water main pursuant to a contract with the Water District; and
WHEREAS, the Trailer Park will be responsible for all costs associated with the water connection including the cost of installing a lateral, a pressure reducing valve, and any other equipment required for the connection; and
WHEREAS, the Trailer Park would be responsible for obtaining any and all permits required for the installation of the lateral; and
WHEREAS, the Trailer Park will have to comply with the Town’s WUL and will have to reimburse the Town for all out-of-pocket expenses associated with the requested water connection; and
WHEREAS, the Trailer Park will be charged by the Water District with the current water rate structure for system; and
THEREFORE, NOW BE IT RESOLVED THAT:
1. The Town Board of the Town of Roxbury has evaluated the request of D&J Trailer Court to connect to the Town of Roxbury’s Grand Gorge Water District and hereby gives its consent to the Trailer Park to make the requested connection for Lot No. 1; and
2. The Town Board requires that the Trailer Park make no connection until Lot #1 is subdivided from the other lots as a separate tax parcel; and
3. The Owner complies with all applicable laws and rules relating to the water system connection.”

Dennis Slater also reported, as part of an Eagle Scout project, 27 of the fire hydrants have been painted and the remaining 27 are to be painted very soon.
Richard Davis of the Grand Gorge Community Action Group reported the group has decided to postpone the Grand Gorge Festival until next year. Davis also presented the Town Board with storage building plans and a site location map for a proposed 18’ X 26’ building that they would like to house beside the Grand Gorge Civic Center propane tanks. They would apply for grant funding to purchase the building. The Town Board will review the plans but stated no objections with the proposed location.
Joseph Resch of the Grand Gorge Business Alliance showed the new logo for their group.
Attorney Kevin Young discussed the grant application for Roxbury & Grand Gorge Water Districts and possibly purchasing property that would allow for a new well and an expanded area of protection around the two current pump houses on the lands owned by Michael Hinkley. The property would need to be subdivided and an appraisal would also be needed. Further discussion took place on the process.
RESOLUTION #40- RESOLUTION OF THE ROXBURY TOWN BOARD AUTHORIZING TOWN ATTORNEY TO ARRANGE FOR AN APPRAISAL OF REAL PROPERTY
On motion of Gene Cronk second by Edward Raeder the following resolution was offered and adopted:
“WHEREAS, the Town Board for the Town of Roxbury adopted Local Law No. 1 of 2010 entitled “Water Supply Law” governing the operation of the Roxbury and Grand Gorge Water Districts; and
WHEREAS, certain real property located at 54400 State Hwy 30, Roxbury, NY (the “Property”) may need to be acquired for protecting and securing the Roxbury Water Supply; and
WHEREAS, the Town Board has determined that an appraisal of the Property is needed to determine the value of the lands; and
THEREFORE, NOW BE IT RESOLVED THAT:
The Town Board of the Town of Roxbury authorizes YOUNG/SOMMER, LLC, Town Attorney, to proceed with ordering an appraisal of the Property.”

RESOLUTION #41- RESOLUTION FOR PUBLIC HEARING ON THE ADOPTION OF A LOCAL LAW FOR FLOOD DAMAGE PREVENTION
“WHEREAS, the Town Board of the Town of Roxbury, New York (the “Town”) deems it advisable to maintain its eligibility to participate in the National Flood Insurance Program (“NFIP”);
WHEREAS, new Flood Insurance Study and Flood Insurance Rate Maps establishing 100 year base flood elevations for the Town have been completed by the Federal Emergency Management Agency (“FEMA”);
WHEREAS, to maintain eligibility in the NFIP it is necessary for the Town to adopt the new Flood Insurance Study and Flood Insurance Rate Maps into its floodplain management regulations;
WHEREAS, the New York State Department of Environmental Conservation (“NYSDEC”) has also instructed the Town Board to update its Flood Plain Local Law to conform to the current rules and regulations required by FEMA; and
WHEREAS, the Town Board deems it advisable to adopt a local law that repeals and supersedes Local law No. 1 of the year 2012 of the Town of Roxbury entitled “Flood Damage Prevention Local Law” to adopt the new maps and to incorporate the current FEMA regulations regarding flood plain management.
NOW, THEREFORE, BE IT RESOLVED, that said Town Board shall meet at the 53690 State Highway 30, Main Street. PO Box 189, Roxbury New York, on June 13, 2016, at 7:15 P.M. to hear all persons interested in the manner of the adoption of the local law, and be it
FURTHER RESOLVED, that the Town Clerk is hereby authorized and directed to publish notice of said hearing in the Catskill Mountain News, the official newspaper of the town, and to post copies of such notice in the manner provided by law.”

Discussion took place on commercial solar farms and the terms of the County resolution on same. Attorney Young also explained the matter in terms of making them subject to Payment In Lieu Of Tax (PILOT).
RESOLUTION #42-RESOLUTION AUTHORIZING ENTRY INTO HOST COMMUNITY BENEFIT AGREEMENTS AS PAYMENTS IN LIEU OF TAXES FOR COMMERCIAL SOLAR INSTALLATIONS IN THE TOWN OF ROXBURYREAL PROPERTY TAX SERVICES
On motion of Allen Hinkley second by Gene Cronk the following resolution was offered and adopted:
“WHEREAS, the Town of Roxbury, Town Board, wishes to cooperate and partner with the County of Delaware and school districts in creating a unified policy to deal with the taxable status of commercial solar installations; and
WHEREAS, the real estate parcels that contain those solar installations will fall into overlapping taxing districts; and
WHEREAS; New York State Real Property Tax Law Section 487 (9) states that solar, wind and farm waste energy projects are exempt from property taxes for a period of 15 years, but are eligible to contribute to their host community through PILOT agreements; and
WHEREAS, the Town of Roxbury, the County of Delaware and many towns, villages and school districts agree that residential and agricultural solar projects should be tax exempt, but commercial solar projects should pay their fair share of the costs of municipal expenses; and
WHEREAS, residential solar projects are defined as projects located at inhabited dwellings, connected to a single phase grid and no larger than 20 kw in size; and
WHEREAS; agricultural solar projects are defined as projects located on lands which qualifies for exemption under Real Property Tax Law § 483; and
WHEREAS, commercial solar projects are defined as any projects other than those defined above as residential or agricultural; and
THEREFORE, upon approval of this Resolution, it is understood that the Town of Roxbury authorizes that the Host Community Benefit Agreements will be put into place for all new commercial solar installations in the Town. It is further understood that taxing districts will need to adopt similar legislation to authorize the Host Community Benefit Agreements. In addition, it is expected that the Town of Roxbury will be the lead agency in negotiating and ensuring that Host Community Benefit Agreements are in place; and
WHEREAS, the Town, within a sixty (60) day period of the request for a building permit or any other formal notification received from an entity notifying the Town of Roxbury of intent to construct a commercial solar installation, will notify such commercial solar array owners that the Host Community Benefit Agreement (PILOT) is in place in the Town of Roxbury and will notify such other taxing districts as described within this resolution; and
FURTHERMORE, all commercial solar panel arrays will be subject to Host Community Benefit Agreements (PILOT) to be put into place by the Town of Roxbury and the proceeds of which will be shared by each taxing district on a pro-rated amount (50% town, 25% county, 25% school); and
WHEREAS, all residential and agricultural solar installations would remain as tax exempt for the 15-year period unless the law changes regarding tax-exempt status. This Resolution only applies to commercial installations; and
WHEREAS, under Section 487 (9) of the Real Property Tax Law, the Host Community Benefit Agreement must not exceed the amount of taxes that the entity would have paid on the new array if there were not tax exemption (For example, if a $100,000 solar farm is built on a $5,000 plot of land, the agreement cannot exceed what property taxes would have been on a $105,000 assessed value); and
WHEREAS, it is understood agreements made pursuant to this resolution shall be for 15 years and that the revenue will be divided among the taxing districts as described above.
NOW, THEREFORE, BE IT RESOLVED that the Town of Roxbury Town Board is in agreement with this multi-jurisdictional cooperation agreement.”

Attorney Young discussed the issues that Grand Gorge Tire has had in trying to hook up their building to the NYCDEP sewer extension. When sewer extension was being built DEP didn’t hook up that property due to unknown soil issues having been a auto repair garage at one time but installed a stub to the property. The owner at that time was okay with no hook up but now the new owner wants the hookup. Unfortunately, the stub is two feet too high so a grinder pump would have to be installed. Under the extension agreement, the Town feels the hook up should be at the expense of DEP and not the owner. The Town is waiting for a response in writing from DEP.
A card has been received from Cub Scouts Pack 41 Roxbury, NY thanking the Town Board for having allowed the use of the Grand Gorge Civic Center for the pinewood derby they held this year.
Supv. Hynes stated the vehicle being looked into for the Constable is not available until June 1st.
A report from the Health Inspector was submitted to the Town Board regarding the results of his inspection on 210 Ridge Rd.
The NYS Public Service Commission has scheduled meetings for public input on the Clean Energy Standard Program.
RESOLUTION #44- RESOLUTION TO GO INTO EXECUTIVE SESSION TO DISCUSS A PERSONNEL ISSUE
On motion of Allen Hinkley second by Gene Cronk the following resolution was offered and adopted:
“RESOLVED, the Town Board agreed to enter into Executive Session at 9:45 pm to discuss a personnel issue. Present were: Supervisor Thomas S. Hynes, Councilmen Allen Hinkley, Edward Raeder, Gene Cronk and Carol Murray and Attorney Kevin Young.”

Notice is hereby given that a Public Hearing will be held by the Town of Roxbury Town Board on June 13, 2016 at 7:15 p.m. at the Town Hall, 53690 St. Hwy 30, PO Box 189, Roxbury, New York to hear all persons interested regarding a proposed Local Law entitled “Flood Damage Prevention Law” under consideration by the Town Board. The proposed local law is available for inspection at the Office of the Town Clerk. In summary, the proposed Local law repeals and supersedes Local law No. 1 of the year 2012 and adopts the new law recommended by the New York State Department of Environmental Conservation in order to maintain the community’s eligibility to participate in the National Flood Insurance program. The proposed Local law includes updated Flood Insurance Rate Maps.
