LEGAL NOTICE OF ESTOPPEL

NOTICE IS HEREBY GIVEN that the resolution, a summary of which is published herewith, has been adopted by the Town Board of the Town of Roxbury, Delaware County, New York, on January 3, 2017, and the validity of the obligations authorized by such resolution may be hereafter contested only if such obligations were authorized for an object or purpose for which said Town is not authorized to expend money, or if the provisions of law which should have been complied with as of the date of publication of this notice were not substantially complied with, and an action, suit or proceeding contesting such validity is commenced within twenty days after the date of publication of this notice, or such obligations were authorized in violation of the provisions of the Constitution.

A summary of the aforesaid resolution is set forth below.  The resolution provides as follows:  that the faith and credit of the Town of Roxbury, Delaware County, New York (the “Town”), are irrevocably pledged for the payment of the principal of and interest on such obligations as the same respectively become due and payable; that an annual appropriation shall be made in each year sufficient to pay the principal of and interest on such obligations becoming due and payable in such year; that the power to authorize the issuance of and to sell bond anticipation notes in anticipation of the issuance and sale of the serial bonds authorized by such resolution including renewals of such notes, is delegated to the Supervisor; that all other matters, except as provided in such resolution relating to the serial bonds authorized, including the date, denominations, maturities and interest payment dates, within the limitations prescribed in such resolution and the manner of the execution of the same and also including the consolidation with other issues, and the authority to issue such obligations on the basis of substantially level or declining annual debt service, is delegated to and shall be determined by the Supervisor; and that this LEGAL NOTICE shall be published.

A RESOLUTION AUTHORIZING THE ISSUANCE OF $400,000 BONDS OF THE TOWN OF ROXBURY, DELAWARE COUNTY, NEW YORK, TO PAY PART OF THE $1,000,000 MAXIMUM ESTIMATED COST OF THE INCREASE AND IMPROVEMENT OF THE FACILITIES OF THE TOWN’S DENVER WATER DISTRICT, IN AND FOR SAID TOWN.

The period of probable usefulness of the aforesaid specific object or purpose is forty years, pursuant to subdivision one of paragraph a of Section 11.00 of the Local Finance Law.

ORDER CALLING PUBLIC HEARING

In the Matter of
the Increase and Improvement of the
Facilities of the Denver Water District in the
Town of Roxbury, Delaware County, New York
at an Estimated Maximum Cost of $1,000,000

WHEREAS, the Town Board of the Town of Roxbury, Delaware County, New York, has duly caused Lamont Engineers, engineers duly licensed in the State of New York, to prepare a Preliminary Engineering Report, dated August 31, 2016, constituting a map, plan and an estimate of cost, pursuant to Section 202‑b of the Town Law (the “Report”), relating to the increase and improvement of the facilities of the Town’s Denver Water District, consisting of various capital improvements to the facilities of the Denver Water District, including wellfield electrical improvements, pumping and treatment improvements, controls system improvements, pressure reducing valve vault replacement, water main and service replacements, hydrant and valve replacements, storage tank rehabilitation, emergency generators, and various building and site improvements all as more fully described in the Report, which Report is on file in the office of the Town Clerk where it is available for public inspection during normal business hours; and

WHEREAS, the Denver Water District is entirely contained within the Town; and

WHEREAS, the maximum amount proposed to be expended for said increase and improvement is $1,000,000, which amount shall be allocated and charged as the cost of various capital improvements to the facilities of the Denver Water District, and shall be borne by the Denver Water District; and

WHEREAS, the capital project heretofore described, based on information supplied to the Town Board, has been determined by the Town Board to be a Type II Action pursuant to the regulations of the New York State Department of Environmental Conservation promulgated pursuant to the State Environmental Quality Review Act, the implementation of which will not result in any significant environmental effects; and

WHEREAS, it is now desired to call a public hearing on the question of such increase and improvement of the facilities of the Denver Water District in the manner described above, and to hear all persons interested in the subject thereof, in accordance with the provisions of Section 202‑b of the Town Law; NOW, THEREFORE, IT IS HEREBY

ORDERED, by the Town Board of the Town of Roxbury, Delaware County, New York, as follows:

At said public hearing said Town Board will hear all persons interested in the subject matter thereof.

Section 3.        The Town Clerk is hereby authorized and directed to cause a copy of this Notice of Public Hearing to be published once in the Catskill Mountain News, the official newspaper, and also to cause a copy thereof to be posted on the sign board of the Town Clerk, such publication and posting to be made not less than ten days, nor more than twenty days, before the date designated for the hearing, and shall constitute the notice required to be given under Section 202-b of the Town Law.

 

Section 4.        This order shall take effect immediately.

PLEASE TAKE NOTICE that the New York State Urban Development Corporation, doing business as Empire State Development (“ESD” or the “Corporation”), pursuant to Section 16(2) of the New York State Urban Development Corporation Act (Chapter 174, Section 1, Laws of 1968, as amended) (the “Act”), has adopted a General Project Plan (the “Plan”) with respect to the MTC Cable Broadband Upgrade Capital Project (the “Project”) on November 17, 2016.

LEGAL NOTICE

PLEASE TAKE NOTICE that the New York State Urban Development Corporation, doing business as Empire State Development (“ESD” or the “Corporation”), pursuant to Section 16(2) of the New York State Urban Development Corporation Act (Chapter 174, Section 1, Laws of 1968, as amended) (the “Act”), has adopted a General Project Plan (the “Plan”) with respect to the MTC Cable Broadband Upgrade Capital Project (the “Project”) on November 17, 2016.  Copies of the Plan are available without charge to any person who shall make a request for the same at the office of the Corporation.  The Corporation will file such Plan in the offices of the Delaware County Clerk; the Andes, Middletown and Roxbury Town Clerks; and the Margaretville and Fleischmanns Village Clerks.  A copy of the Plan is also on file at the principal office of the Corporation, 633 Third Avenue, New York, New York 10017, and is available for inspection by the general public Monday through Friday, between the hours of 9:00 a.m. and 5:30 p.m.

The Project will deploy an HFC Network, which is engineered to deliver 100 Mbps residential service, as well as up to 200 Mbps business class services within the towns of Andes, Middletown, and Roxbury; Villages of Fleishmanns and Margaretville by Heart of the Catskills Communications, Inc. (d/b/a MTC Cable).  This network will upgrade approximately 217-miles of facilities serving existing customers to meet New York State’s broadband service goals and objectives. Installation of 22-miles of new HFC facilities will extend broadband availability to residents not currently served by the HFC network. Total Project costs are expected to be approximately $1,749,922.  ESD proposes to make a $1,224,946 grant to Heart of the Catskills Communications, Inc. (d/b/a MTC Cable) to assist in the financing of the Project.

PLEASE TAKE FURTHER NOTICE, that, in accordance with Section 16(2) of the Act, a public hearing, open to all persons, will be held by the Corporation at the Town of Roxbury- Town Hall, Conference Room, 53690 State Highway 30, Roxbury, NY 12474 on Friday, December 16, 2016 from 11:00 AM to 12:00 PM, to consider the Plan.

"Making Your Own Herbs de Provence" is the scheduled activity for the Tuesday, November 8, 2016, Roxbury Library Association Tuesday Forum program session at 1:00 p.m., at the Roxbury Library. RLA Tuesday Forum Coordinator and session leader Susan Whittenburg cordially requests that each attendee bring a container for storing the herbs.

Regular RLA Tuesday Forum attendees will provide refreshments following Ms. Whittenburg’s demonstration.

The Roxbury Library Association welcomes the public to all RLA Tuesday Forum programs, activities, and gatherings, which are free of charge.

Located at 53742 State Highway 30, the Roxbury Library is directly opposite the town’s United Methodist Church on Main Street.

ON 2017 BUDGET

NOTICE IS HEREBY GIVEN that the Proposed Budget of the Grand Gorge Fire District of the Town of Roxbury, State of New York, will be presented to the Board of Fire Commissioners of the Grand Gorge Fire District, for its consideration.

A PUBLIC HEARING will be held from 6:00 p.m. to 7:30 p.m. at the Grand Gorge Fire Hall, 60753 St. Hwy 30, Grand Gorge NY  12434, in the Town of Grand Gorge, State of New York on the 1st day of November, 2016.

Pursuant to Town Law 105, the Board of Fire Commissioners must hold a public hearing on the budget, make the proposed budget available to the public prior to the public hearing, allow the public to comment on the budget at the public hearing.  This public hearing must be held to allow maximum public participation in the hearing.

The purpose of the public hearing is to allow any person to be heard in favor of or against the proposed budget as it is submitted, or for or against any item or items contained in the proposed budget, and hearing all persons interested in the subject  concerning same.

That a copy of the proposed budget is available at the Office of the Town Clerk of the Town of Roxbury at Main Street, Roxbury NY 12474 and Fire District Secretary at 60753 St. Hwy 30, Grand Gorge NY  12434 where it may be inspected by any interested person during office hours.

Notice to Bidders

Sealed bids will be received by the Town of Roxbury, hereinafter referred to as the "Owner," until 3:00 PM, Thursday, November 17th, 2016, at the Town Clerk’s Office, 53690 State Highway 30, Main Street, Roxbury, NY 12474, at which time said bids will be publicly opened and read aloud for:Denver Water District Contract No. 1 – PRV Rehabilitation

NOTICE TO BIDDERS

1.     Sealed bids will be received by the Town of Roxbury, hereinafter referred to as the “Owner,” until 3:00 PM, Thursday, November 17th, 2016, at the Town Clerk’s Office, 53690 State Highway 30, Main Street, Roxbury, NY 12474, at which time said bids will be publicly opened and read aloud for:

Denver Water District Contract No. 1 – PRV Rehabilitation

Contract No. 1 shall include all tools, labor, material and equipment necessary to: Provide a new precast concrete valve vault with 6” and 2” pressure reducing valves and all related appurtenances; and provide all related demolition, site work, and restoration.

Deductive Alternate No. 1 – Cost Reduction for Re-use of Existing Vault.
Deductive Alternate No. 2  – Cost Reduction for Smaller Vault.

2.     All bids must be made on the blank form of proposal attached hereto.

3.     A bidder may withdraw any proposal submitted prior to the hour set for the closing of the bids provided the request is signed in a manner identical with the proposal being withdrawn.

4.     The Owner will be responsible for payment in accordance with the terms of the contract when the work is completed.

5.     The Owner is exempt from New York State sales taxes on material, supplies, and equipment to be permanently incorporated in the Work.  Tax Exemption No. 15-6001121.  Said taxes shall not be included in the Bid.

6.     A complete set of Bidding and Contract Documents may be obtained from Lamont Engineers upon payment of a $50.00 deposit.  Full deposit refund for the returned set will be made provided that the complete set of Bidding and Contract Documents (Project Manual) is returned to Lamont Engineers, postage paid and in good condition within 30 days after Bid Opening.  Any sets returned after the 30-day period are non-refundable. Additional sets of Bidding and Contract Documents may be obtained upon payment of a $25.00 deposit for each set.  Deposits for additional sets will be returned less the actual cost of reproduction if the complete sets are returned in good condition within the 30-day period. Requests for delivered sets of Bidding and Contract Documents will be honored overnight upon receipt of a non-refundable fee of $25.00 per set for handling and delivery.

7.     Prospective bidders who obtain electronic project documents are responsible to contact Lamont Engineers, P.C. to register their contact information on the project documents distribution list for the purposes of receiving bidding Addenda and other bidding information.

8.     The Contractor will be required to meet funding agency provisions as identified in Document 00823.

9.     The Town Board of the Town of Roxbury reserves the right to waive any informalities or irregularities in the bids received and to reject any or all bids without explanation.

10.  The existing PRV Vault site will be open for review by bidders on Tuesday, November 8th, 2016 from 10:00 AM-11:00 AM. If bidders are unable to make this time, they may try to schedule an appointment with the operator Robert Payne at (607) 326-3141 (WWTP) or (518) 231-9955 (cell).

UNAPPROVED MINUTES

ROXBURY HISTORIC PRESERVATION COMMISSION

A meeting of the Roxbury Historic Preservation Commission was held October 15, 2016, at 10:15 a.m. at the Roxbury Town Hall.  Present Lewis Wendell, Chairman, Commission Members Nicole Haroldson and Doug McLaurine. Also present Carolynn Faraci, Commission Clerk.

Wayne Bank has not submitted their application on Phase Two for the sign on the front lawn.

Doug McLaurine asked questions about the work he will be doing after the purchase of Jerome Liberatore Property located at 53587 State Highway 30, Roxbury, New York 12474.

Kingdon Gould and the O’Connor Foundation each provide Five thousand for the five historical signs to be placed in Roxbury.  The signs will be located at Roxbury Arts Group, Enderland, Roxbury Railroad Depot, Jay Gould Memorial Reformed Church and Family Home (5005 Vega Mountain Road).

There will be paper maps showing where the Historical signs will be placed in the Town of Roxbury.
