The regular meeting of the Town of Roxbury Planning Board was held September 20, 2017
at 7:30 pm at the Roxbury Town Hall.
Present: Chairman Phillip Zorda, Members Robert Cole, Brad Zambri, David Cowan and Edward Hinkley, Kristin Janke-Schneider of the Delaware County Planning Department.
Absent: Joseph Farleigh
The meeting was called to order at 7:30 pm.
The Minutes of the July 19, 2017 meeting were approved on motion of Ed Hinkley second by David Cowan.

August 16, 2017 Meeting
Present: Chairman Phillip Zorda, Members Brad Zambri, David Cowan, Kristin Janke-Schneider of the Delaware County Planning Department.
There was no official August meeting due to the lack of a quorum. However, Dennis and Diane Muthig, Jump Brook Rd., Grand Gorge were in attendance to ask about subdividing their property. They were told the procedure to follow and we discussed some issues they might have in connecting the new parcel to town water and sewer.
Boundary Line Adjustment – 92.-1-16.2
Joe and Linda Rohacevich – NYS Rte. 23
Linda asked if it was possible to add a piece of land to the side of their property and also to add a piece of land across Rte 23 to their property. The land would come from Linda’s mother’s parcel, 92.-1-16.1. The Board explained that it would fall under a Boundary Line Adjustment and Linda was given a copy of the BLA application. The Board also explained the procedure to follow.
Jean Stone – Resignation
On August 11, 2017 Phillip Zorda received an email from Jean Stone tendering her resignation from the Planning Board.
On motion of Brad Zambri second by Robert Cole the meeting adjourned at 8:00 pm.

The regular meeting of the Town of Roxbury Planning Board was held July 19, 2017 at 7:30 pm at the Roxbury Town Hall.
Present: Chairman Phillip Zorda, Members Robert Cole, Brad Zambri, David Cowan and Edward Hinkley, Kristin Janke-Schneider of the Delaware County Planning Department.
Absent: Joseph Farleigh, Jean Stone
Brian Murray, a town landowner, was also present. The meeting was called to order at 7:30 pm.
The Minutes of the June 21, 2017 meeting were approved on motion of Dave Cowan second by Robert Cole.

Sketch Map No. 157.3-2-25
Mary Ann Todd – Lake St. – 2 lot subdivision
A sketch plan of a 2 lot subdivision prepared by Victor Fairbairn for Mary Ann Todd was reviewed. It was proposed that the commercial kitchen and a 0.21 acre parcel be subdivided from the original lot, leaving the residence on the remaining 0.51 acre parcel. Concerns were raised about access to the kitchen and the ability to install separate sewer and water connections to the kitchen within the kitchen parcel.
On motion of Robert Cole second by Dave Cowan, the Planning Board denied the subdivision as shown on the sketch map.

Brian Murray owns parcel 1157.-3-8.1 upon which a small airstrip exists. He discussed his ideas for expanding the airstrip.

Chair Phil Zorda opened the Public Hearings at 7:30 pm.
a. MapNo.157.2-1-20.1
Dennis Slater – 2 lot subdivision on Old Route #30
Applicant submitted: proof of mailing, copies of public hearing notices, final application, Short Environmental Assessment Form, survey map, metes and bounds description of new parcel and $10.00 of the remaining fee due.
b. MapNo.92.-1-8.11
Van Aiken – 3 lot subdivision represented by Rob Allison.
Applicant submitted: waiver for the soils tests, proof of mailing, Ag Data Statement sent with the public hearing notice, final application. Short Form EAF and fee submitted last month.
143.58 acre parcel proposed to be subdivided into 3 lots. 39.94 & 79.23 acre parcels to be sold to NYC Department of Environmental Protection (NYCDEP) and 24.41 acres to be retained with the house. General discussion of NYCDEP land acquisition process. Due to the property being located adjacent to the Grand Gorge Waste Water Treatment Plant the applicant has requested a waiver of the soils tests.

Dollar General Site Plan – Represented by Larry Marshall of Mecurio-Norton-Tarolli- Marchall Engineering & Land Surveying
Applicant submitted: full site plan, landscaping plan, lighting plan that is dark sky compliant.
7,500 square feet (85 x 85) Dollar General to be constructed on the corner of West side of State Route #23 and South side of School House Drive. Site plan contains 27 parking spaces and is ADA compliant. The site will be served by public water and sewer. The lighting plan has five poles in the parking lot and on the building. The lights will be dark sky compliant and facing down to avoid affecting adjoining properties. The existing structure and macadam/gravel will be removed from site and a detailed landscaping plan that includes size, species number of plants has been prepared.
The applicant has contacted NYCDEP for WWTP hook-up and stormwater pollution prevention plan details. They are awaiting comments.
The building aesthetics are similar to the town highway garage.
Questions:
? When will construction start? Spring 2017.
? How will the structure be heated? Propane.
? How long will construction take? 3-4 months. Hope to open by 7/4/17. Primax Properties who owns the property will hire a general contractor to build the store and they have a policy to use local contractors whenever possible.
? How many employees? There will be a total of 8-10 full-time and part-time employees.
? What are the hours? The store will be open 8 am to 10 pm 7 days a week.
? Is this a franchise? No, this is corporate – Dollar General will have a long-term lease from Primax Properties.
? Can how the structure looks be improved? In some areas Dollar General makes the stores look more aesthetically pleasing, is this possible? The ability to improve the appearance of the store is tied to the calculated market strength and location of the store.
As there were no additional questions/comments from the public Chair Phil Zorda closed the Public Hearings at 8 pm.
Chair Zorda called the regular Roxbury planning board meeting to order at 8:00 pm.
Motion to approve the August 2016 planning board minutes by Dave Cowan, second by Ed Hinkley. Motion passed unanimously.
Old Business
a. Map No. 157.-2-1-20.1
Dennis Slater Subdivision – Planning board reviewed the Short Form EAF and identified no potential negative impacts.
Motion by Joe Farleigh to issue a Negative Declaration, second by Dave Cowan. Motion passed unanimously.
Motion to approve subdivision by Ed Hinkley, second by Rob Cole. Motion passed unanimously.
Chair Zorda signed the maps and informed Mr. Slater he had 62 days to file the maps.
b. MapNo.92.-1-8.11
Van Aiken Subdivision – Motion to waive the soils tests for the subdivision due to the proximity to public WWTP hook-up made by Jean Stone, second by Rob Cole. Motion passed unanimously.
Planning board reviewed the Short Form EAF and identified no negative impacts. Motion by Ed Hinkley to issue a Negative Declaration, second by Dave Cowan. Motion passed unanimously.
Motion to approve the subdivision by Joe Farleigh, second by Dave Cowan. Motion passed unanimously.
Chair Zorda signed the maps.
c. Map No. 91.2-9-13
Dollar General – Represented by Larry Marshall
Applicant received comments from NYS Department of Transportation (DOT) on the width of the entrance. DOT wants a narrower opening. Due to truck deliveries this could be an issue so the applicant will continue to work with DOT on a viable entrance. DOT also asked for road shoulder reconstruction however that is not necessary as the WWTP hook-up is on the site and the shoulder will not be disturbed.
The applicant is waiting for comments from NYCDEP on the stormwater plan and the board informed the applicant to contact the Catskill Watershed Corporation to explore potential funding assistance.
No sidewalks will be added to the site.
The aesthetics of the building should be improved and the planning board will like to see examples of other designs for consideration. Mr. Marshall will bring them next month.
General discussion of the proposed signage at the site. The applicant wants to erect a ‘lollipop’ sign. The planning board determined this type of sign isn’t suitable for the site & road and speed location. The applicant will provide designs for a monument sign on the site.
The applicant will continue to forward all correspondence for the project to the Chair. Average septic usage for the building is 30 gpd.
Dollar General will be back next month with the requested information.
4. Motion to adjourn the meeting at 9:15 pm by Joe Farleigh, second by Ed Hinkley. Motion passed unanimously.

Motion to approve minutes of April 20, 2016 meeting – Jean Stone moved, seconded by Dave Cowan, Motion approved unanimously.
Present at the meeting were Rob Allison – Catskill Region Surveying Services, Greg Henderson and Joe Massa – The Roxbury Motel. As required by the Board’s approval of the Site Plan for The Roxbury at Stratton Falls, Rob presented the Board with updated site plan drawings showing final locations of stormwater discharge, sewer and water supply systems. Also, copies of letters from NYCDEP’s approval of the SWPPP and sewage treatment system, NYS Department of Health’s approval of the water supply and sewage systems, NYSDEC’s approval of the permit for trails along Stratton Falls, and OPRHP’s letter of No Adverse Impact were presented to the Board.
Our Site Plan Law states that a site plan approval is only in effect for one year and an extension can be requested in writing. As our original approval was given at the May 2015 meeting, Greg presented the Board with a letter requesting a two-year extension of the approval. Regulatory approval delays and grant delays were among several reasons construction has been delayed.
A letter will be sent to Greg and Joe indicating receipt of the above documents and the extension of the site plan approval.
Motion to approve a two-year extension – Dave Cowan moved, seconded by Ed Hinkley, Motion approved unanimously.
Commercial Solar – Phillip Zorda stated that the county and town have approved resolutions approving PILOT agreements for commercial solar “farms”.
NYCDEP Land Acquisition – the Board reviewed LAP #8999, 243.-3-17, a 6.57 acre parcel located off Red Kill Rd. The county will be reviewing this acquisition and will make any comments necessary to the town.

New Business:
There was a general discussion regarding Commercial Solar Installations being proposed in the area. Nicole Franzese advised that land owners need to be diligent when signing leases regarding taxes and other inherent obligations that occur if and when the solar company abandons the installation.
Phil Zorda stated that one of the responsibilities of the Roxbury Town Planning Board is site plan review and that the Town’s attorney has indicated that commercial solar would fall under our review. Stephanie from the assessor’s office has suggested that parcels leased for solar installations be subdivided to protect the land owner and any ag exemptions they may have. Twenty acres is generally the minimum number of acres for a commercial solar installation.
The board was advised of a Land Acquisition Project by the state of New York on Hard Scrabble Road near Duggan Hill consisting of three small lots; NYC parcel # 8027 totaling 28.34 acres. The acquisition was review by the Delaware County Planning Board and no action is necessary by the town board.
The Delaware County Planning Board adjusted the town map for the Hamlet of Grand Gorge to reflect three parcels removed from the map at the request of the land owners. No action necessary by the town board.
There was a mention of what is involved to designate RT 30 as a scenic route. Apparently a group from Schoharie County has approached the town about the possibility.
